It is madness thinking you can put your hands on someone for any reason besides self defense and avoid consequences because they had said something to provoke you. But if responding to racism was the only reason for an attack and that can be proved the the very minimal level of introducing reasonable doubt of a hate crime, then you should only be convicted of the lesser charge of assault and/or battery (simple or aggravated). But if it is not true, (and the obvious victim of a crime in this situation is likely the most reliable witness between herself and her accusers), then what a lie. But ok if the veracity of this is in doubt, that is not enough to eliminate reasonable doubt. But if anyone things that the charges should be dropped because the defendant or a witness made such a claim, they are really very deluded or wrongheaded. The victim was a racist and said racist things toward me is not and should not be a perfect defense against battery charges.
